Censorship & Child Pornography

Hi there,

On another similar forum recently there's been a change in the rules due to a recent U.S. court ruling. Now characters that are below or look below 18 are not allowed to be displayed on the forum. Is this something that is likely to be put into place on this forum?

No I am not installing any rule like this. Pretty much everyone here has been tasteful in the postings. Pornographic posts are okay so long as the character is of age or implied of age. If anyone starts posting Penny Gadget in double penetration then yeah, there'd be a problem with that. But everyone seems to keep to the "DiD" aspect of DiD regardless of the sexual implications it has to the board members.

The law in question is the Protect Act of 2003, and the courts have poked so many holes in it that it's practically been repealed (it's still on the books but 95% of it has been ruled unconstitutional). Only one guy has ever been prosecuted under it and he could have been acquitted if he hadn't plead guilty because of huge pressure from the prosecution and a really good plea bargain. In order to be prosecuted under it the images have to be unambiguously obscene (hardcore sexual images with utterly no artistic value) and of characters that are unambiguously underage (i.e. anyone borderline like Kim Possible, the Sailor Scouts, etc. would be fine). I don't think anything ever posted here remotely qualifies.

Oh, that Protect Act. From the OP I thought it was something more, well, relevant.

It's a lot easier to get away with it in deviantART.

You just create a loli-looking OC, claim that she's over 18, put her in "double penetration" situations and PROFIT!!!!!

It's harder to take down loli porno drawings unless you have some sort of wikipedia entry or official information that proves the girl is under the age of 18.
Otherwise, deviantART won't lift a goddamn finger.

Good lord I remember reading about that, I think that guy was already convicted of something once before. Plus shouldn't CP laws be designed to, you know, protect children who are, you know, real? I never got the point of locking people up over fictional art, but hey, this is America, we just love locking people up! So much so that we have a quarter of the world's prisoners with the highest incarceration rate of any country in history! All that money used for taking care of people that don't need to be in jail can be used for better things like fixing our roads and bridges, feeding and sheltering the poor, giving our veterans reasonable living conditions, tackling global warming, finding cures and vaccines for diseases and conditions, and etcetera! /rant

I can see why they'd cut down on it. There are people who become so obsessed with this shit that eventually drawings aren't enough and they go out to harm real kids.

There was one other guy who was, but he didn't appeal because they also caught him with the real deal and it wouldn't have done any good (sort of like how you're not going to bother contesting a seatbelt ticket if they've got you on reckless driving). The guy I'm talking about, Christopher Handley, had a completely clean criminal record and was just importing some manga for his collection, the vast majority of his manga didn't have any nudity at all in it. From what I heard the prosecutor knew the guy would win his appeals probably even before it got to the Supreme Court, but the guy also had a sick mom and was her only caretaker, so he basically worked that angle, saying "yeah you might get off on appeal but that might take a year and your mom might be dead by the time that happens, take the plea and you'll be out in 30 days". I mean the prosecutor was INCREDIBLY overzealous and strong-armed the guy into taking the plea bargain just to get another "notch" on his belt. He completely railroaded him into pleading guilty.

Also, he only got him on an obscenity charge (which because of the earlier court ruling is all you can get for drawings).
